By accessing or using xoxoyachts.com (“the Site”), you agree to be bound by these Terms of Use. If you do not agree, do not use the Site. The Site is operated by AST USA LLC (“we,” “us,” “Operator”), doing business as XOXO Miami.

2. Use of the Site

The Site is provided for informational purposes and to facilitate charter booking inquiries. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site.

3. Intellectual Property

All content on the Site — including text, images, logos, design, layout, and code — is the property of AST USA LLC or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without prior written permission.

The XOXO name, logo, and brand identity are trademarks of AST USA LLC.

4. User-Submitted Information

When you submit information through our forms (inquiry, booking, guest sign-up), you represent that the information is accurate and that you have the authority to provide it. We handle your information in accordance with our Privacy Policy.

5. Booking Terms

Charter bookings are governed by our separate Booking Terms & Conditions, which you accept at the time of booking. These Website Terms of Use do not replace or modify the Booking Terms & Conditions.

6. Third-Party Links

The Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of those sites. Inclusion of any link does not imply endorsement.

7. Disclaimers

The Site and its content are provided “as is” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

While we make reasonable efforts to keep information on the Site accurate and up to date, we do not guarantee the completeness or accuracy of any content, including pricing, availability, and vessel specifications. Confirmed pricing and terms are provided in your booking confirmation.

8. Limitation of Liability

To the fullest extent permitted by law, AST USA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless AST USA LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Site or violation of these terms.

10. Modifications

We may update these Terms of Use at any time. The effective date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance.

11. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.

12. SMS Terms

By opting in to SMS messages from Offshore Creative LLC (XOXO Miami’s billing entity), you agree to receive text messages for customer support, service updates, and other communications related to your account.

You can cancel the SMS service at any time. Just text STOP. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance.

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
