Booking Terms & Conditions

1. Service Provider
All charter services described on xoxoyachts.com are provided by AST USA LLC, a Florida limited liability company (“Operator”). XOXO Miami is the marketing and booking brand of the Operator. By completing a booking, you enter into an agreement directly with the Operator.
2. What’s Included
Every XOXO charter includes: licensed captain and crew, fuel, full lounge setup, coolers and ice, water and soft drinks, silverware, plates, cups, napkins, and sound system. The price you see is the price you pay — no platform fees, fuel surcharges, or hidden costs.
Optional add-ons may be available at additional cost and must be requested in advance. Current pricing and availability are listed at xoxoyachts.com/pricing.
3. Pricing
Current charter pricing is published at xoxoyachts.com/pricing and is subject to change. The price confirmed in your booking confirmation email is the price that applies to your charter.
4. Booking & Deposit
A booking is confirmed only upon receipt of a 25% deposit of the total charter price. The remaining 75% balance is due on the day of the charter, prior to departure.
Deposits are processed through Stripe and payable by bank transfer (ACH) or credit card. ACH transfers are processed at no additional cost. Card payments include a standard processing fee of 2.9% + $0.30, which is added to the deposit amount at checkout and passed through to the payment processor.
Deposits are collected by Offshore Creative LLC, XOXO Miami’s billing entity, on behalf of the Operator. Card statements will show “XOXO YACHTS MIAMI.” All deposits are non-refundable except as described in Section 6 (Weather & Safety).
Bookings require a minimum of 24 hours’ advance notice.
5. Cancellation & Rescheduling
All deposits are non-refundable.
7 or more days before departure: You may reschedule your charter to any available date within 6 months at no additional cost.
Less than 7 days before departure: No rescheduling. Deposit is forfeited.
No-show: Full charter price is due.
6. Weather & Safety
The captain has sole discretion to cancel, delay, shorten, or alter the route of any charter due to weather conditions, sea state, or safety concerns. The captain’s decision is final.
If the captain cancels the charter before departure due to unsafe conditions, you may reschedule to any available date within 6 months at no additional cost. No refunds are issued for weather cancellations.
If weather deteriorates during a charter and the captain returns to dock early, a rescheduling credit for the remaining time may be offered at the Operator’s discretion.
Rain or overcast conditions alone do not constitute grounds for cancellation. Customer-initiated cancellations due to weather forecasts are subject to the standard cancellation policy in Section 5.
7. Guest Conduct
All guests must follow the captain’s instructions at all times. The final guest count must be confirmed at least 24 hours before departure. Exceeding the confirmed guest count is not permitted and may result in denial of boarding.
The captain reserves the right to return to dock and terminate the charter if any guest’s behavior poses a safety risk or disrupts other passengers. No refund or rescheduling credit will be issued in such cases. Guests are responsible for any damage caused to the vessel, furnishings, or equipment during the charter.
8. Scheduling
Charters may depart as early as 8:00 AM and must return by 12:00 AM (midnight). Departure and return times are confirmed during booking. Late returns due to guest request may incur additional charges at the Operator’s hourly rate.
9. Gratuity
Gratuity is not included in the charter price and is not required. If you enjoyed your experience, a 15% tip for the captain and crew is customary and appreciated.
10. Liability & Assumption of Risk
Guests participate in the charter at their own risk. Maritime activities carry inherent risks including but not limited to: drowning, slips and falls, sun exposure, seasickness, and contact with marine wildlife. By boarding the vessel, all guests acknowledge and accept these risks.
AST USA LLC, its officers, employees, and crew shall not be liable for any personal injury, death, property damage, or loss arising from participation in the charter, except to the extent caused by the Operator’s gross negligence or willful misconduct.
11. Personal Property
The Operator is not responsible for loss, theft, or damage to personal belongings brought aboard.
12. Photography & Media
XOXO may photograph or record video during charters for marketing purposes. If you prefer not to be featured, please inform the crew before departure. Guest-taken photos and videos are for personal use; commercial use requires written permission from the Operator.
13. Governing Law
These terms are governed by the laws of the State of Florida and applicable federal maritime law. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
14. Acceptance
By paying the deposit and completing the booking confirmation, you acknowledge that you have read, understood, and agree to these Booking Terms & Conditions on behalf of yourself and all guests in your party.
